Smoking Workplace Rights Australia: 4 Critical Rules Employees Should Know

By Michael Whelehan | Certified Master Hypnotherapist and Master NLP Practitioner | Breathe Hypnotherapy | Updated September 2026

Smoking workplace rights are more limited than many Australian smokers assume. There is no single law that covers them. Instead, what you can and cannot do at work comes from a mix of your award or agreement, your employer’s policy, state smoke-free laws, and workplace health and safety duties.

How Do Smoking Workplace Rights Actually Work?

The starting point is your break entitlements. The Fair Work Ombudsman explains that awards, enterprise agreements, and other registered agreements set the rules for paid and unpaid rest breaks and for meal breaks. So the first place to look is your own award or agreement, not a general rule.

Employers also have a duty to keep people safe. Safe Work Australia explains that a person conducting a business or undertaking has a primary duty to ensure, so far as is reasonably practicable, the health and safety of workers and others affected by the work, including visitors. This is the legal background to workplace policies in general.

4 Rules Behind Smoking Workplace Rights

  • Your award or agreement sets your breaks. Check what your award, enterprise agreement, or employment contract says about rest and meal breaks. That is where your entitlements are written down.
  • Employers can have a smoking policy. In Bajada v Trend Windows and Doors, the employer’s policy allowed smoking only in designated areas during scheduled meal and rest breaks, and the Fair Work Commission treated that policy as clear and reasonable.
  • Repeatedly ignoring a clear policy can end in dismissal. In that case the employee was warned several times and offered time off to seek support, then breached the policy again. The Commission dismissed his unfair dismissal claim despite his long service of about 14 years. This is one case decided on its facts, not a rule that applies to every situation.
  • Enclosed workplaces are smoke-free by law. According to Tobacco in Australia, published by Cancer Council Victoria, every state and territory bans smoking in enclosed workplaces and public places, and the details differ from state to state.

How This Differs From Smoking Workplace Costs

Our guide to smoking workplace costs looks at what smoking costs employers. This article looks at it from the employee’s side: what your workplace can require and what the law says about where you can smoke.

What Smoking Workplace Rights Mean If You Want to Quit

For many people, workplace rules are just one more reason to stop. Restrictions on where and when you can smoke, warnings, and the stress of managing breaks around a habit all add up. Knowing where you stand is useful, but it does not remove the habit itself.

If you are unsure about a specific situation, such as a warning, a policy change, or a dispute, contact the Fair Work Ombudsman, your union, or an employment lawyer. This article cannot advise on individual circumstances.

Why Willpower Alone Often Isn’t Enough

Most smokers already know the risks and the rules. Anyone who has tried patches, gum, or sheer willpower and gone back to smoking knows that understanding the situation and being free of the habit are different things. Nicotine dependence runs through the subconscious mind and the body’s stress response, not just conscious decision-making, which is why so many quit attempts fail even when someone genuinely wants to stop.

To be clear, hypnotherapy does not treat any medical condition. It helps people stop smoking by working with habit and trigger patterns.
